With the lack of details the most likely case is that the FA just plain forgot she did not have a CCW permit and that she was carrying a gun into a controlled area.

I'm betting you have the smarts to know when I say 'sound' I meant 'a situation where it appears an FA forgot they had their weapon in their carryon' vs 'Jihad Jamie' and by posting that you are being antagonistic in that fun, internet way we have all come to love. :D

However, I accept that you make your point...... and we shall see if Amber turns out to have islamic terrorist ties, I suppose.

Well I did say I doubt she is terrorist and do expect it to be a simple mistake. But a mistake that needs APPROPRIATE punishment. I emphasis that word to make sure that no one mistakes what I am saying. I said it before but it bears repeating. that appropriate in this case is a fine, maybe suspension of her ability to use weapons, additional training, etc. I do not think she should lose her job if it was a simple mistake, but she appears to not have a carry permit and did not use good judgment. That does require attention. She should not get off scott free. All of this is subject to the investigation.
 
Well that sounds very reasonable and I think I can agree with all that.

Except that part where you use your name to describe the penalty!

It sounds to me that this gal, in all likelihood, was just a working stiff like the rest of us - busting it every day to make a living. Probably in a constant state of exhaustion like many flight crewmembers thanks to the schedules, had to get up at 4 am again, rush to catch the shuttle before facing another day in the cattlecars, and yes - carrying, so that she would have some prayer of saving her skin from an ugly crime in one of the many dangerous cites she must travel to. Simply forgot to move it to the correct place before hitting security. A mistake which in all likelihood would never would have resulted in danger to the public.

The problem with taking a hardline on the interpretation of our laws is that - besides being devoid of reasonableness and compassion - it sure could bite when that law then is applied to you or someone you know. If you can claim perfection, go for it. But I don't think Amber deserves 18mo in the state pen for this.

Dave, the sense I'm getting from your posts in this thread is that you appear to feel that it's acceptable to ignore a law (e.g. having a CCW permit) if that law doesn't, in your opinion, reduce danger to the public. If that's the case, then I wonder how you feel about laws regarding speed limits? Aviation medicals? Pilot licenses? Etc.? In other words, how are we as a society to determine which laws are "valid" and which can be ignored?

Now, I agree that her punishment should be commensurate with the crime. However, the crime is more than just "forgetting" one morning that she was packing. It was a (presumably) reasoned decision to own and carry a handgun without being legally licensed.

What exactly is the appropriate punishment? I really don't know, but I don't think that just saying "Oh, you just forgot, so you get a pass" is it. Nor do I think that 18 months of hard time is it.

If someone is already carrying a gun without a permit, how would suspending their ability to use weapons affect them in the slightest?

Sounds sort of like saying to someone caught driving without a license, "from now on you _really_ aren't allowed to drive, okay?"

Personally, I'd like the punishment to be sufficient to encourage those who wish to carry weapons to actually follow the rules...

I fail to see why the law shouldn't apply to this person in the same way that it would apply to any other.

Unless, of course, we want selective justice.
 
Grant, I dont think I said -and I didnt mean to imply- that we selectively ignore laws.
But I don't see many of our laws in black and white as others do.

I suspect the law against guns being carried aboard is to prevent gunplay or hijackings - a necessary law. If the evidence in this case is able to show that she was never the intent, (as I wrote in post 1), I hope there is leniency. She did wrong so she shouldn't get off.

I'm afraid I would not make a very good anarchist; I too, like my law and order and appreciate what it provides for us.
When it comes to meting out justice though, I don't always agree with choosing only the extremes: either "Innocent so you go home" or "Guilty so you fry". You have to look at each case's details, imo.

Here in Pennsylvania, folks with that problem are simply the most scrupulous traffic law abiders on Earth. If the Speed limit is 35, they're doing 30. If the light turns yellow 3' from th intersection, they stop.

I know a guy that drove about 10 years without a license. He was always *extremely* cautious. Obeyed every traffic law to the letter. He finally got his license again and I went for a drive with him. He ran two red lights by mistake in a two hour time period....Not scared of the police anymore so not paying as much attention.
 
I have an uncle by marriage who has packed a pistol illegally in his state for years and years. To my knowledge he has never been caught. He doesn't qualify for a ccw permit due to some minor problems in his past. These folks are legion.

Problem is he was denied a CCW for a good reason, dang it.

BTW I definitely see him doing something like this FA and getting busted one day. That, or being half (or more) in the bag and deciding as a bystander to plug a fleeing 13yo shoplifter in the heat of the moment.

I am not sympathetic about it either. i think the calls for her to be let off are premature and unwarranted.

But human nature is what it is, and people are forgetful about a lot of things. Gun owners are no different than the rest of the population. I do not think it unreasonable that gun owners will be in the range of responsible to irresponsible. As far as I know there is little in the way of any proof that one is competent to own a weapon.

We had at least one instance each training cycle of some knucklehead "forgetting" his weapon. This resulted in lots of "dummy cord" being strung between offender and equipment..

I thought they all had to go through security.

This has happened many times. The most noteworthy case was when a wife packed a husband's (pilot) bag and didn't realized there was a hand gun in it from going to the range. She just put somethings into the bag; he grabbed it and left and the klaxons sounded at TSA. Jerry Jones did it here in Dallas.

I don't know how many cops y'all know, but my B-I-Law is a constable, a gun being left in a car or on a seat isn't an uncommon occurrence. Folks are human-they err.

I could have been busted in Mexico. Took a back pack I later found out had a couple .45 rounds in it. I had taken my gun to the range using it before and somehow a couple rounds fell into the bottom. When I took the gun out and re-packed, never saw those rounds. Months later, I threw some things in it to go to Mexico. It was only when I looked in one zipped pocket for something I couldn't find, I saw the live rounds. (They are still somewhere in Mexico).

I could tell you story after story about folks in the Army when in RVN that swore their weapon wasn't loaded when it went off. Tired, not feeling well, etc and just not thinking clearly. There was stupid stuff, but, more often than not, someone just wasn't thinking clearly. Lost more folks to accidents than enemy fire my second tour.

I will step in....I too am a gun owner and I carry concealed.

I think that the "laws" on the books today are invasive and am happy to see them struck down.

I am honestly willing to compromise...have background checks, make sure records are clean, heck even require a safe gun handling course (ala hunting permits). However, once that is done, someone that goes through that should be be allowed to own ANY DAMN WEAPON THEY WANT.

I would even allow for the registration of certain "mass destructive" weapons, but I still should be allowed to own them. However the farce that is the NFA system, and how one can go to jail for random bullshyte is ridiculous.

The CDC has been tracking gun deaths for years. Slightly over half are suicides. The vast majority of the rest are homicides, mostly people shooting folks they know, family members and friends. Citizens heroically defending their homes against the forces of evil are fairly rare. Accidental discharge is also, fortunately, somewhat more rare.

This is all actually to the advantage of gun owners. If most shooters were maiming and killing random strangers, gun laws would be far more restrictive than they are.

There is a principle in Common Law of proportional force, e.g., you can't bring a flamethrower to a knife fight (unless you are 5', 90 lbs and surrounded by 100 knife fighters).

The potential damage of caused by a larger, more powerful weapon system such as an M1 tank, an armed F-16 or B52 is so extensive that it does not make sense for individuals to have access to owning and using such weapons.

You can purchase and own a .50 caliber MG, but certain qualifications and restrictions apply.

And yes, individual citizens are limited in access to force. That's the social contract we all agreed to in exchange for Self Governance.

I agree with you.

The problem, and the reason that we've gotten away from that, is that once upon a time it turned out that certain judges would give certain people 5 years for the same crime that they'd give others 20 years for. The obvious difference was race, but you also saw wealth, sex, and a few other things play a role.

So, in terms of sentencing, judges no longer have discretion but are instead confined to narrow ranges of sentences.

I'm not going to go further than this for fear of SZ material, but certain "shalls" in the Constitution have been interpreted by the Supreme Court as not meaning "shall." In other words, where the Constitution says "shall not be infringed" or "shall make no law," the Supreme Court has interpreted those as meaning "may be infringed" or "may make laws."

Now, those certainly might be the compromises that are necessary to have a functional society and "ordered liberty" (a term which I feel is reasonable, but again which appears nowhere in the Constitution), but at the same time - we have to acknowledge that we don't actually do what the Constitution says. Meaning that it's kind of a pointless document, because we just do what we want regardless of what it says....

So, I really enjoy the law, and I always do my best to apply the Constitution, but I keep the previous sentence in the back of my head, too.

Anyway, with all that being said, your last sentence is completely accurate.

My carryons would suck at transporting weapons and I just would not want to risk the 'mistake' of forgetting what I had in one of my plane bags. Are gun cases so expensive that people need to use luggage for gun transports?

Here is my question. Why would anyone want to carry a gun in the same bag as they might use to fly on a commercial plane? I've done it plenty of times. I have to carry one backpack all the time as my company laptop goes everywhere I go. Sometimes I'll have a pistol in a small case inside the laptop bag. That way I'm not carrying a gun case which is another thing that could be lost and an obvious case that someone might want to steal.

Before I take an airline flight I dump the contents of all my bags and search them about ten times.

I had a similar problem once almost bringing knives to the airport. I solved that by buying a 2nd backpack for only airline travel and one for home stuff. When I would go on the road I moved only my laptop to the other TSA friendly case. That way I never accidentally forget something in it.

But, yeah, if you are not going to do that, you need to be very careful and search several times. The allowable room for error is slim these days.
 
But considering she appears to not have a carry permit in the first place one has to ask the question what it was doing in her purse?

No stats, but just from talkin' to folks.....it appears many, many believe it is their right to carry, regardless of state laws. Very common to carry without zee correct papers.
