Pilot arrested for operating while intoxicated after plane crash in South Bend

I dunno…adrenaline does some weird things if you can’t use it to run like hell.
I've seen guys get *awful* goofy after close calls. Friend of mine had just put out a fire in his shop as I drove up. He was walking around, shooting the CO fire extinguisher at flowers, birds, etc. while laughing maniacally.

Though maybe it's just *my* friends....

Seeing someone act goofy is not a legally usable proof of intoxication. It might give a reasonable suspicion that there is such. The FSTs are more involved than just observing if someone acts strangely.

I've seen FSTs successfully attacked in court, but you have to have specific reasoning to show why the specific observations had another explanation, not just say "well, he just crashed." Nearly all the serious crashes I rolled on as a paramedic involved impaired drivers.

61-year-old XXXX of Mill Creek failed the field sobriety test after the crash and was arrested for Operating While Intoxicated - Endangerment and Operating While Intoxicated.


In the comments: don't they have grooming standards for pilot licenses theses days, or do you think that tosseled look came from the crash?

Oh, yes, agree there...no objection if such behavior triggers an official test. Just that non-specialists in the vicinity might be claiming someone's under the influence when such is not actually the case.

I went to a CAP cadet party once, where I spent five minutes teaching another cadet how to walk through walls*. Was perfectly sober, just in a goofy mood.

* Didn't actually walk through walls, course. Would lead the other guy to the wall, then stop and ask about his background and qualifications, and whether he was truly, TRULY serious about doing it. Repeat a half-dozen or so times....

Run like hell is what he should have done and explained later he was in a state of shock. On the other hand Indiana Jones confused the taxiway for a runway sober. This guy just missed the driveway a little. Nice flying. I wonder if his house is in the neighborhood and he was just trying to get home.
 
HIMS really has NOTHING to do with preventing someone from flying drunk. It has to do with getting people identified back to flying after having been identified. No preventative measures, no real consequence.

It seems to be being viewed as “treatment”, or care, or something medically relevant. It’s not. It’s a method to deal with an administrative process.

It hasn’t, it doesn’t, it won’t EVER prevent this sort of malfeasance.
it sure does have to do with preventing at least one pilot from flying drunk. But I cannot say more.....
