Hello,

Asking for a friend (really!) Does a Misdemenor Assult charge only have to be reported if it ends up being a "convection"? Or does the charge need to be reported regardless of the outcome? I saw it on the "list" but only under "Convicted of." I should know this answer, I'm a CFI.

More importantly, you should know where to find the answer (it's not POA).

I looked it up in MedExpress (Also AME guidelines) and am 98 percent sure I know the answer just thought there'd be no harm in asking SGOTI. Pardon ruffeled feathers. I wondered if some random guy or gal had inside knowledge.

If you read the instructions, under 18w, it’s only convictions. But there are two potential gotchas.

One is 18v. Notice that it doesn’t only cover drugs and alcohol, but referrals to educational or rehab programs. For example, in an assault case a court might conditionally order an anger management class as an alternative to a criminal record.

The other comes down to “what is a conviction?” That can get into the weeds of the details of procedural rules. I learned long ago that most people who have been through the criminal process, even repeat offenders, have very little knowledge about it beyond a superficial level.

In the case of court action, unless it’s a very clear “yes,” I always advise a professional view of the court record.

That's true. "Guilty" is a legal conclusion matching proven (or admitted) conduct to a legal standard. "Did it" is somehtine else entirely.

But my all time favorite was the business cards members of the LA Public Defender's office used to carry. On the reverse was a drawing of an alligator in a crosswalk. Caption read, "if you don't talk you could walk."

a layman doesn't need to make the distinction, in other words, lawyers don't get insist on just one definition and use of the word "guilty." And wouldn't it be more accurate to make a distinction between being guilty and being found guilty?

Yeah, this was a one off thing. No prior anything. The gal is even saying it never happened (It didn't she just "got mad"......I know), but that won't help the "charged" part. It's just a mess and I want to make sure he's got all his T's crossed and I's dotted, if you know what I mean. He's got a good lawyer. Stinks (and I'm a chick) that cops simply take the word of a woman. This nailed another pal of mine who married a psycho. I feel for you guys (not that it's OK to hit a Woman).

Perhaps it might be worth him to join AOPA and pay for the Pilot Protective Services. An aviation lawyer could spend a little time going over the legalities with him. Similarly, a consultation with an AME (who could potentially make an inquiry up the chain without names being mentioned) could provide some clarity on this somewhat grey area.

I was worried about the "convection" myself ... having flown only here in the southwest mainly;)
 
Ouch, so I am a terrible speller; can't I also be concerned for my friend? I've never been able to spell well....again, sorry. Didn't Mom say somthing along the lines of, "If you have nothing nice to say.......?" I am also typing with one hand as I had surgery on my Right and it's in a cast.
