Homeland Security Expanding Ramps Checks?

I agree, Tom, only I would have used "governed" instead of "ruled," even though ruled is closer to the actual these days.

I chose "RULED" simply because the heads of the departments like EPA, DOT, Education, make the RULES we are required to live by. And we have no method of firing them.

I think your use of that term was appropriate for our current state of affairs. Ideally we should be governed, or preferably led, but it's come down to being ruled.

Another twist

I usually fly to the Bahamas VFR, my buddy was going to fly over to get me because I took over a boat and needed a ride back.

Flying over VFR you have a large window of hours to get in the air with your flight plan.

When you file IFR, you have only a small window of time to get in the air. My buddy filed IFR... when my buddy closed the hanger and was cranking up, he was surrounded by three CBP marked cars. After an hour search, he was released,,, they were looking for money... because of OBUMMER and his tactics, people were taking their money out of the country.

They also made him open my hangar up and searched it..no reason given.

If they thought I had money, I would have helped them search, I could have used the money...

Warrant? If no - that would not happen.

I'm doing a search of the US Code for aircraft right now. There are over 900 hits. While the search of the hangar is probably illegal, it sounds like they over-stepped their authority on the airplane search. So far there is only one statute that I can find that allows warrant-less searches by CBP....

8 USC 1357: Powers of immigration officers and employees
(a) Powers without warrant
Any officer or employee of the Service authorized under regulations prescribed by the Attorney General shall have power without warrant-
(3) within a reasonable distance from any external boundary of the United States, to board and search for aliens any vessel within the territorial waters of the United States and any railway car, aircraft, conveyance, or vehicle, and within a distance of twenty-five miles from any such external boundary to have access to private lands, but not dwellings, for the purpose of patrolling the border to prevent the illegal entry of aliens into the United States;

Since they admitted they were looking for money, and had no probable cause or reasonable suspicion, it sounds like they worked on your ignorance (and that's not a slam) of the law. Remember, unless you flatly deny then them consent to search, any little saying that might be consent will be jumped on. You also have the legal right to say where and what they can search. I'll keep looking to see if I can find more stuff for everybody.

You guys are funny looking up laws, they mean nothing, the big piece of paper isn't worthy of wiping George Washington's but.

I look up the laws not only because I want to, but since I'm also a badge-carrying, gun-toting Fed I want to make sure what I'm doing is legal. Search and seizure is a pretty touchy topic and area of concern for the law. Cases have been thrown out because of violations of it.

You have a citation for the case law on point?

The AOPA Pilot magazine last month had a long article about this, and that was the interpretation of their attorneys. Not sure if there were actual case citations in the article.
