Don't want a foul ball THAT badly!

Not sure I want to see it Nick! He fell about 30 feet, backwards... went out on a gurney.
 
Announcers are saying he is responsive, conscious, moving all extremities. Four people he fell on are being treated at the ballpark.
 
Cue demand letter from blood-sucking plaintiffs' lawyer in 5... 4... 3...
 
If the guy landed on me, I'd sue the guy (and tell my lawyer not to sue
the ball park, the club owner, the manufacturer of the ball, ....)
 
Who are they gonna sue ?
The team owner, Major League Baseball, the architects who designed the stadium, the contractors who built it, the guy who hit the ball, the pitcher who threw the pitch, Louisville Slugger, Rawlings, the people he landed on for not being soft enough, the guy's mommy for raising him to have no common sense, the FAA, Anheuser Busch, Isaac Newton, and Kevin Costner.

Wanna bet that the ticket includes a waiver of liability? Of course, that doesn't mean that he can't sue them, but I would expect it would decrease (not eliminate) his chance of success. Of course, if they were negligent, or should have reasonably foreseen this, then...
 
I will have to look at the current codes for handrail heights, but,,,

My gut feeling is if that railing was 42" or more from the surface he was/could/ maybe standing on then the stadium should not be held liable. Since he fell on 4 other people that will for sure create a tangled web of lawsuits.

I'm convinced that the guy was an Astros fan that saw real baseball for the first time this year and just had to end it...

Wanna bet that the waiver doesn't hold up:

- Plaintiff didn't read it.
- It's not him who is suing but his wife for 'loss of conjugal pleasure', him accepting the waiver has no bearing on her case.
