Have you looked around at the "average" American nowadays? More like 5'6".
 
I've never met the guy and I don't have the full story. But making that little statement suggests he knew at the time what he was doing was risky but did it anyway. He could have just left it out and it would not effect his story regardless.

All that said, this guy has no doubtedlty been counseled to the contrary and insists on pushing his intent to continue drinking. It's worth noting that no describes their drinking as problematic.

You're making a BIG assumption based on his statement of fact regarding the incident. Unfortunately we can't ask the individual why he included that statement, but he could have also easily included it to point out how stupid and unnecessary it was for him to drive home.
 
Tolerance and denial. That's evidence of a drinking problem. Don't try and equate .15 to "social drinking". It takes 9 drinks in an hour for a 220-pound male to get to .15. When was the last time you had 9 drinks in an hour?

9 drinks an hour would be considered binge drinking. A more likely scenario would be 2 - 3 drinks an hour over a three hour period...

He said he was at a Christmas party (or get-together, or whatever), 1/2 mile from home. So maybe a local bar or restaurant. A large margarita, dinner and a beer, another large margarita afterward, maybe finishes his wife's, gets pulled over as soon as he leaves the parking lot.

Some of those big mixed drinks, especially the "premium", can hold enough shots to count as multiple drinks. 2-3 of those, and a beer or two, and you are up to 7-8 drinks before you know it.

That's what I thought at first too, but then I re-read it. It actually says he had been at a Christmas party, and the "incident" happened 1/2 mile from home. To me that sounds like the party was somewhere further away, and he was almost home.
 
Was this individual's medical certificate ever suspended?
 
I understand that, but I don't see that the pilot in question had his medical certificate revoked. He reported as noted above but nowhere do I see he lost his medical. I don't believe a DUI arrest results in an immediate revocation of a medical certificate. It looks to me like the pilot in question would have been better served to go the BasicMed route instead of applying for another third class and starting this process...

he re-applied and was deferred for futher eval.

Yes it did. It's interesting that with an increased scrutiny of an airman's DUI history and potentially subjecting an individual to a long arduous process that the FAR's still allow piloting an aircraft with a BAC < 0.04. That makes sense...

Got caught in Jefferson Parish, 1/2 mile from home, after a party in New Orleans. I wonder how far he drove at that BAC before getting caught turning into his neighborhood?

Perhaps, I guess it comes down to what "Established Medical History" is defined to mean. I also think it's arguable that you can conclude an individual has developed a tolerance to alcohol based on one BAC sample in an non-clinical setting.

In any case, had he been willing to wait another 6 months the two year window would have expired and BasicMed would have been a slam dunk. As it is, he's rolling the dice and based on some of the learned comments it's clear he has an uphill battle with the FAA to get an SI...

And years ago in Texas, drinking a beer while driving home from work was unofficially allowable. And before that most of the DUI stops resulted in a stern warning, "Go straight home and don't let me see you out again tonight.!!"

When I was 19, I stopped at the local dognburger to get a couple chili cheese dogs. I had been drinking. I was probably very near .10. A cop saw me walk across the parking lot towards my truck. He drove up to me and said, "Get in. I am taking you home." And that is what he did. I guess being known by the local police as a hot rodder might have helped.
 
Ordering extra chili cheese dogs probably helped as well. Did you get him a Fresca, too?

I probably changed the oil in his (not attractive) daughters car and did a lube as well. I did that a lot with the local police back then.

Those were the days.

When I was a teen and got caught doing something (that I was doing) they'd offer me the choice of resolving it with them or my father. I always chose my father, although that punishment was harsher (think corporal). The only thing to compound the 'reinforcement' was if I didn't confess to Dad before he saw the officer who spoke to us before mass on Sunday.

Confession, while good for the soul, was also good for my backside. :)

I read this and think "the guy knew he was drunk but since home was only .5 miles away he thought he'd chance it." That's demonstration of at least two FAA hazardous attitudes.

Or the half mile away was were the party occurred and he was stopped right by there, no way to know without more full facts.

Different people have different addictions. For some people, it's alcohol. For others, it's overeating.
 
So...are some people born with tolerance? Or is all tolerance from repeated past drinking?

Tolerance is acquired. It starts off low, then gets higher over time, then begins to drop off. The level of tolerance is a variable, defined by a persons physical make-up. The propensity for addiction is also a variable, defined by both genetics, and psychology.

Even my scenario of a couple drinks before, during, and after dinner and not realizing it catches up doesn't work. This was a Christmas party: probably had food, and maybe lasted 2-4 hrs?

Hey, I'm not throwing stones here. I'm just saying, this guy isn't an occasional, light drinker as he claims.

Kinda what I was getting at. I know things can surprise you if you aren't a regular drinker, sometimes that Margarita is potent. But to reach that BAC took some effort.

I guess we will have to disagree on that. There are a few BAC calculators online that I have tried and they all agree that if a 180 LB middle aged male consumes between 7 and 8 drinks over three hours then his BAC will be at least 0.15%. That level of drinking is not uncommon. I'm not defending the guy's actions, there is no excuse for driving intoxicated, but I don't believe you can draw the conclusion that based on this one incident he has an alcohol problem.
 
I try to stick to a 2 beer limit, maybe on a rare occasion 3. Weight is about 230. I have formed the opinion if I am ever stopped to request an actual blood test instead of blowing in a device calibrated by a policeman. I am sure most are good but just like prosecutors don’t know if I trust all of them? So not being experienced would this be a good thing to do or a mistake?
 
I think most here are failing to see the big picture.... if someone has tolerance, and they can behave correctly (read pass roadside sobriety), than why not send them on their way even if they’re 0.25???
I mean if they can drive just fine... why punish someone because they have tolerance??
Is that a new law that I’m not aware of??? Driving just fine but you have tolerance?
