That brings up a good point. I know the PIC cannot have alcohol and I know it's against regs to carry drunk passengers in part 91. I am not sure if anything is preventing a student doing dual to not be drinking alcohol...as long as they are under the limit of drunk.
I know of no such regulation, either, but I think the FAA will view consumption by the paying passenger of alcohol provided by the operator as being indicative that the alleged "training" is merely a deception to avoid the "carrying passengers for hire/compensation" rules, and I think any ALJ or the NTSB will go along with that.
 
Students can be entertaining enough. I don't think being tipsy is going to help the situation. I personally wouldn't want anyone up front that's drinking. That's all I need is a good bump and me and the whole plane smelling funny along with a passenger having access to the controls.
 
As I mentioned previously, option one which is the only one where manipulation of the controls is mentioned doesn't say anything about champagne and chocolates. The other options only say that you will receive ground instruction prior to the flight.

Agreed. As I said earlier, only option #1 appears to be legal without a 91.146 LoA or Part 135 certificate. Trying to pass off any of the others (which all include champagne) as "flight training" is what I was discussing in that regard.
