Background:

I was diagnosed with ADHD and have been off medication for almost four years. In the past, I had two public intoxications (with BACs of .138 and .151) and three other instances in which I was caught with alcohol in the dorms at college, leading to counseling. The results of this counseling also listed me as a regular marijuana user. All of this occurred before I was 21, and I am now 27 with no issues since then.

Current Situation:

It appears that, moving forward, I will be classified as alcohol dependent and required to undergo the full HIMS alcohol dependency step-down plan. From my understanding, this will start with 14 random alcohol tests per year. After about six months, I will have to see a HIMS psychiatrist. Even if the psychiatrist provides a clean report, I believe I will still be considered alcohol dependent by the FAA.

Given this situation, would hiring a lawyer be beneficial, and how could they assist me in navigating this process?

This is not a situation to argue about. Do it the FAA’s way or you won’t do it at all.

What legal basis would you have to overrule an FAA administrative / medical finding? Saying your not an addict is not a winning strategy. If anything get with a competent AME and jump through the required hoops.
