For an airplane that’s transponder equipped but outside the 24 month inspection, can it be flown as a non-transponder equipped aircraft? Reading 14 CFR 91.215, I’d think yes. 91.413 seems a little more questionable. Any thoughts on the answer?

My assumption based off of 91.215(c) is that the aircraft is no longer maintained per 91.413, so non-transponder rules apply.

Mark it as "Inop" and fly? That might work... Might not be able to go to Class Bravo.

The aircraft may be operated with the transponder off outside the Mode C veil of Bravo, outside and not over Class C and under 10,000 MSL (except 2500 AGL). ATC can approve operations with no transponder for B and C.
 
It can also be operated in much of that airspace with prior approval of the controlling facility, along with a ferry permit as needed, to take it to a maintenance facility.
