The spectrum near GPS L1 was "protected", that's why LS needed to apply for a waiver to use their frequency from the ground. It's fairly clear that their plan from the beginning was to place the burden of compatibility on the GPS user community but it's looking like the LS gamble isn't going to pay off unless the FCC gives them another windfall in the form of a different spectrum slice they can use. Some folks are suggesting that this is the outcome LS was hoping for from the beginning.You may be right that the FCC is to blame. Certainly somewhere in there the Gov't dropped the ball and never took steps to protect the GPS spectrum properly. And you'd think that since so much depends on it (even if it's just to give adequate time signals to networks) they'd have caught on.
