One way around that, I believe, is carrying a non-owned aircraft policy. If it works like any other insurance, then if there is a question about coverage after an incident, the insurance companies sort it out amongst themselves. For the plane owner that could be a big deal, but for the one renting/borrowing/whatever it shouldn't be. Disclaimer - not an insurance or legal guy.
