MedExpress question NOT involving a DWI/SSRI

Here's a curveball I haven't seen asked yet:

Med Express question pertaining to any non-vehicle arrests (murder, assault, etc):

When I was 18, a group of us thought it would be fun to egg another acquaintance's house. She identified us, and for some reason I was the only one who had the police waiting for him when I got home. I ended up pleading nolo contendre to Criminal Damage, paid the court fees, fine, and restitution to the girl's father.

The questionnaire says to list the charge and the date in the explanation box. Would "Criminal Damage" cause any problems?
 
Depends. In the state of the violation, is this a misdemeanor or a felony? YMMV
Are there any other actions on record? It's about pattern, unless it's a felony. If it's a felony in your state, then it's about WHICH CATEGORIZATION is it.
 
It's the only non-traffic offense I've ever had, and it was 27 years ago.

When did 18w change from "convictions" to "arrests?" It's still "convictions" in the latest information I can find (this month's MedXpress User's Guide).

I asked my question above because there is a BIG difference between an arrest and a conviction. And, in many locations, a first offense like this might be handled as a non-criminal diversion, in some cases wit no conviction at all. So, my suggestion is to get a copy of your record and review it with a lawyer to determine whether there is anything you need to disclose to begin with. Even if there is something to disclose, a conviction followed by a dismissal or expungement is disclosed differently than a straight conviction.
 
Sorry for the seemingly endless follow ons....

I'm not sure how the whole visit to the AME plays out. I'm getting the feeling that they go over your form, ask questions, and (according to their guide) decide: a) approve on the spot, b) Deny on the spot, or c)defer to OKC.

In other words, it's up to the discretion of the AME as to how serious they interpret the questionaire and the applicant's responses? I was initially under the impression that they just perform the physical assessment and then let OKC be the final judge on the question stuff.

You are correct, it's "convictions", my mistake.
It was so long ago, but I had to go to court, enter the plea, and pay the consequences. Forgot to mention that I also received 2 years un-supervised probation. I've always assumed it was a "conviction".
 
You egged a house when you were a kid.... they won’t care. There are actual human beings on the other end of the application for a medical. They might laugh but seriously just report it so you won’t be caught lying on the app.

I stopped being surprised that most defendants in the criminal justice system, particularly those who have only had a brief run-in with it, have no idea how their case was actually disposed of.

If you simply cannot find out, I agree with @Tarheelpilot that it's better to disclose something minor you did not have to disclose than to get caught up in the FAA's process for dealing with misstatements on a medical application. And an ancient egging is "probably" going to get more chuckles than frowning stares. But my personal philosophy is it's better to know one way or the other and respond both accordingly and honestly.
 
You need better relatives.

I have a friend [no really] arrested in Chicago 31 years ago for criminal mischief. He was standing at the end of the street when his girlfriend and her friend picked some flowers from someones yard [4 in total]. They arrested the two guys even though the females admitted to doing it and had possession of the flowers. "We always arrest the men" was the response of the CPD officers.

They had a trial. My friend had lots of connected relatives - connected on the Dillinger side of things. There was no file and no arrest record and no one was willing to admit why he was supposed to be in court that day. So - his case was dismissed. The other guy had a lawyer he did not know show up - he asked about 5 questions on cross. The complaining witness did not see anything - until after the women had the flowers in their hands. You know - what did you see? I was asleep until I heard the laughing. Did you at any time see my client in possession of the flowers? No. Did you ever see my client? Only after he was in cuffs. To be clear you did not see my client pick your flowers? No.

Does he report that? No arrest record. No NCIC record. No court record. How do you explain it? How do you prove it even happened? If HE can't find any evidence it existed - is the FAA really going to go find a station house booking record for a crime in 1987? Some people have all the luck.
 
And I’ve often thought that the large majority of the PoA population has spent time on the Group W bench

Which question on the medical application asks for a report on that? :dunno:
