Guy pulls a pistol at Gaston's Resort bar...

Texas is a bit different. Several times someone with a cc permit has shot someone not directly threatening them. In the most noteworthy, fella saw a guy shoot a lady in a mall parking lot. Perp got into his car and began driving away. CC owner shot him through the car door from his car. GJ no bill. One can stop a felon from fleeing a crime scene. Doesn't mean it's smart, but legal here. One can also protect property in some circumstances or another person.

Best,

Dave

Can't say I feel bad for the guy. He had it coming...As you mention, the main thing is to understand your state laws because they vary dramatically. When you're operating in other states do you best to understand their laws and be very conservative.

My general rule is that I wouldn't use a firearm unless I thought I needed to in order to stay alive. If I do end up falling on the wrong side of the law (and I shouldn't) I won't be questioning it because it's better then being dead. There are some situation-dependent items that can swing this a bit either way.

If someone has the drop on you, can you draw your pistol and shoot them before they shoot you? Would you try? Would you do something to distract them, then make your move? What would you do under that circumstance? Just throwing things out for the sake of discussion. I don't have the answer.

You can if you're this guy:

Raylan: Jess, you ever hear about a spot snipers call "the apricot"? It's where the brain stem meets the spine. Hit a fella there, he ain't gonna pull no trigger. It's just (click), lights out.

then, "You gonna hit the spot from there?"

Not me. (nods head to his partner) BANG!

That will really screw up the rules and rhythm with cops and real criminals because you're not supposed to shoot until you're done talking and the Marshall Dillon standoff happens.
