The subject of that article did not hold a remote pilot certificate, as the incident took place long before part 107 went into effect. So in this case, the FAA took enforcement action against the only applicable certificate--his commercial pilot certificate. At the time, the only way the pilot in that story could operate was under a 333 exemption. He knew that too, as the FAA letter indicates he contacted the office prior to the event and was provided with information on petitioning for an exemption. So in this case, the violation was intentional.
