Forget drones, now they're shooting at ultralights

Here in Arkansas, you don't see too many people hang-gliding. Ol' Zeek decided to save up and get a hang-glider. He takes it to the highest mountain, and after struggling to the top, he gets ready to take flight. He takes off running and reaches the edge--into the wind he goes!
Meanwhile, Maw and Paw Hicks were sittin' on the porch swing talkin bout the good ol days when maw spots the biggest bird she ever seen!

"Look at the size of that bird, Paw!" she exclaims.

Paw raises up," Git my gun, Maw."

She runs into the house, brings out his pump shotgun. He takes careful aim. BANG...BANG.....BANG.....BANG! The monster size bird continues to sail silently over the tree tops.

"I think ya missed him, Paw," she says.

"Yeah," he replies, "but at least he let go of ol' Zeek!"
 
Liquor and guns, never were a very good combination. :rolleyes2:

Makes me seriously reconsider building that Dr.1. The way thing are today, some idiot will shoot at it because "its the bad guys"
 
Why not attempted murder?

In Colorado for murder you have to show intent to actually kill the guy. That's a bit more involved than assault which just requires intent to cause harm. Now if he'd actually killed him it, because the death arose from a felonious act, that would be murder. Usually in Colorado you file assault charges in parallel with the attempted murder as the latter often doesn't get convicted.

It's only second degree assault because even though he used a firearm, it only resulted in harm rather than serious harm. Even so it's good for 4-12 years and he will be barred from owning firearms for a long time.

In what world is shooting at a guy in an ultralight not an intent to actually kill the guy?

The OP cited a story that said the ultralight pilot was flying over his own corn field, checking his irrigation system. The pilot should be complimented for finding a good use for an ultralight.
 
What kind of mess would this be of he had shot at an airliner? he would be front page news for weeks to come and would raise some serious questions about everything from firearms laws/owner rights to airspace regs. I feel he should be prosecuted as such and have the book thrown at him to send a message and make an example of him. What he did was despicable. I remember a case here in my neck of the woods where a guy was golfing on a course near an airport, he intentionallyhit golf balls into the path of a landing plane and actually hit one. He was in some deep doodoo. These arseholes need to have their privilege of being free to walk the earth stripped since it has been made apparent that they cannot show any thought for others safety and well being.

$5 that the hunters and the farmer know each other and that words have been exchanged in the past about hunting too close to his farm.

One article about the incident says he was shot at over his own property, another one says he was shot over the dove field. The ultralight operating rules say that you can only use them for recreation or sport, inspecting your irrigation system is a commercial enterprise.

As a general rule, ********edness is distributed in pretty much equal parts between hunters and ultralight pilots. He undoubtedly knew they were there and put himself in a position to get shot at. This is no different from the PETA activists who run around in bear territory during the season and then claim that people where threatening them by carrying 'high powered rifles'.

But no, they shouldn't have shot him.

Interesting point re Part 103. I agree it doesn't sound like sport or recreation. But I'm wondering about the commercial part.

Would you similarly say that a private pilot farmer cannot inspect fields or cows when flying a Piper Cub under Part 91 because the flight is commercial? It seems to me the inspection flight it is incidental to the business of farming, and there is no customer, passenger, or cargo involved, so it is not commercial flying. But what do I know.

Aerial survey and photography in furtherance of his own business is a-ok under part 91 with a private ticket.

'Checking his irrigation' sounds like a BS after the fact explanation why he had to buzz around over their dove field at low altitude.

We also don't know if it's really an ultralight. The press is notably inaccurate with such things.

A private pilot is not enjoined from operating in furtherance of a business. Student and sport pilots are.

I fully understand your point and I am not a lawyer. I just know if I were to intentionally point and fire a gun at someone, my intent would be to kill. I believe that is true in almost all instances with all people. But that is just my reasonable and prudent nature speaking out, not worth much in today's legal world.
 
If I hear "send a message" one more time I'll puke. How about just enforce the rules/laws consistently, without passion or prejudice? Like that part about equal protections? Send that message for a while. . .
