I wonder if the "instructor on board as observer" could be used by folks who are medically prevented (because of color blindness) from flying solo at night in order to meet the requirements for a commercial ticket?

Absolutely yes! That means colorblind pilots can now become instructors if they want (but will have to find someone else to do the night flying with their non-PIC-qualified trainees).
