You are not flying however you are appropriately rated in seaplanes. The engine fails over a large enough body of water that it cannot glide to shore. Who is PIC now ?

Depends on the hazardous attitudes of the crew IMO.
 
You do not need a seaplane rating to fly an amphib to and from land.

If the PIC of the theoretical amphib is not seaplane rated and the engine fails over water, they simply land on water under the provisions of 91.3 which allows one to deviate from a rule as necessary during an emergency. No need to switch PIC responsibility at all.

Do you think he would be expected not to land on water if flying without a seaplane pilot in the other seat? “Oh no, I better shoot for that rocky shoreline so I do not break a reg.” Of course not. Land it on water.

That being said, good ADM might dictate that the non seaplane PIC hand the controls to the seaplane pilot. However, he can still maintain his PIC status.

And no, you would not need a glider rating to land without power either. :D

1. Leaned forward
2. Had avionics that ATC was always saying were accurate
3. Bought a Bonanza
4. Or worse case scenario pulled the parachute ...

......... This would never have happened.:p

That is a discussion you may want to have with the pilot as the plane is gliding. It's your decision on whether a round of beers afterwards is worth taking legal responsibility for being PIC. I mean, I would.

But it's pointless in reality. The pilot would be in the same boat, so to speak, if he was flying a non amphibious aircraft or seaplane.
