IMHO the bitchin has raised more attention and thus done more damage to the OP reputation than the original statements.

It is only libel if:

1) it is defamatory in nature
2) it is untrue
3) it has caused provable damages

Given that no one has any idea about the posts to which you are referring, my guess is that the three criteria above have not been met.
AFaIK it doesn't matter if the three criteria have not been met as long as POA management didn't make the posts. As several others have said, POA for the most part isn't responsible for the content of member's posts and for reasons I cannot fathom Dominque appears to be unable to grasp this. In his/her opinion POA must delete the material he/she contends is defamatory but it would appear that POA management disagrees (as they should IMO).

Affirmative :yes:. I was just saying that the original post that PO'd him, which he claimed was libel, probably isn't such. Either way, just as you said, POA management wouldn't be liable.

Unfortunately, there is precedent for a publisher to be sued for libel (or defamation) for something posted by a third party. AvWeb was sued several years ago over a post (or posts) made in response to an AvWeb blog, on the claim that AvWeb didn't monitor its forums well enough. Avweb litigated for a while and eventually posted a retraction. No telling if money changed hands.

I always laugh when someone starts talking about suing over something said on an Internet forum. Right or wrong you've now gotten everyone's attention as "that $&#%*". And these kinds of things are almost always idle threats as it isn't practical to do so...and everyone knows that and people rarely take it seriously.

One would think it would be easier to just refute the untrue claims.
 
There is an infamous aircraft broker, I think in Scottsdale, who came on the Red Board to dispute/explain/counteract something someone posted about his/her operation.

You can sue almost anyone you want for any reason. That doesn't by itself make a similar claim valid.

True. The point was that others have been forced to cry "uncle" in similar circumstances, regardless of how miniscule the claim appeared to be.

IIRC AvWeb settled, because the person suing was an attorney who could keep causing trouble for them where as defending themselves cost AvWeb money.

Anyone know if that ever actually went to court?

Arthur Wolk. Avweb and four posters were sued but settled out of court for an apology I believe. You might wish to look up the Wikipedia article on him.

Yep, I am sure it did not get to court. Joe Williams was one of the defendants and had to also offer an apology. If he wasn't banned on just about every pilot board you could ask him about it.
