If this is supposed to be a Red-Black tree with green representing black, it's not balanced correctly, it seems to me. This sort of small irritation is why I quit XCKD years ago. The exact moment was when it became very clear that the author never heard of Snellus Law (which permits to find the optimal lawn crossing path without bothering with functionals). He constantly substitutes quasi-education for real one. Or maybe I'm just mad with "engineers" that come out of college these days. Cute tree though, and in color too.
 
It's certainly not a red-black tree, clearly not a balanced tree of any kind, but there's no reason why it must be inconsistent with the name "tree", and it's certainly a legitimate "binary tree". The heap is a legitimate heap, as well, if we presume that a node's value is determined by the size of its gift box.

Well, the problem might be that his degree said 'physics'.
