It's the airlines fault...

Trans States Airlines is gonna have a bit of explaining to do about this -- to the other TSA. The security folks don't take kindly to unbadged folks being left in the SIDA.

The TSA aren't the only FEDs going to be very unhappy. The flight attendants are in for a violation and possible certificate action at least. The FAA has violated FAs for stepping off the plane to use the jet bridge phone to call for service items while there are passengers on board. Leaving one on board unattended, with doors locked and/or slides unarmed would be huge.

Sleepy, drunk or otherwise, as a ticket-holder, her safety, convenience and general well-being is the responsibility of the crew until she exits the plane, and TSA and others are responsible for making sure unauthorized people are not inside airplanes sitting idle on the ramp with no crew present. She's entitled to something beyond an apology, IMHO.
The charges and damages in the suit are definitely inflated, but one is supposed to aim high and wide when filing a suit, right?
What kills me about this one is that confirming all pax are off the plane is SOP and not exactly complicated. It's not like she was hiding somewhere.

This reminds me of the kid left on the school bus stories that we tend to hear about at the beginning of each school year...

That happened to my oldest when she was in first grade or so. Fell asleep during the trip home (elementery school kids), was still on the bus (and sleeping) when they brought the high school kids home. Finally someone found her when the bus was back at the bus garage.

The wife was in a bit of a panic when she hadn't arrived home on time...

Same here when a substitute bus driver missed her stop. Found her when she looked back into the bus when she parked in the bus lot.

That would be a mild statement about my wife's state at the time.

Back to the subject, Trans State does hold significant culpability on leaving this woman on the plane. It was a stupid thing to do on so many levels.
:mad2:

"It's not like she was hiding somewhere."

hmmm, interesting thought - maybe she was (and hiring Feiger is a dead giveaway that a scam is on, imo)...
How could she be inconspicuous as the people deplane... Normally the FA comes down the aisle closing the overheads, etc. as they leave the plane for the next crew...

denny-o

1) The airline totally messed up here from both a Security standpoint and pax service stand point

2)In order to have a claim in most instances you need both liabilty AND damages.

IMHO is there liabilty yea probably to some extent. Are there damages? IMHO Na other than the WTF moment and a bit of drool dripping down her cheek what the hell are her damages? I guess if she missed here kids wedding or a connection perhaps but otherwise I'm at a loss.

It's the emotional trauma of realizing you screwed up and no one else took care of you. After all you can't expect anyone to be responsible for thier own actions now can you?

The article on our local TV station's web site says she was on a long trip from Detroit to suburban Washington DC to Philadelphia. DTW-IAD-PHL is a long trip??? I think a few of us might dispute that. :D

And I've been left on a plane alone. Had a trip from IAH to SEA via ORD a number of years ago. One flight number all the way. We were delayed getting out of IAH by thunderstorms over head. When we arrived in ORD they announced a bunch of connecting flights, but said nothing about the continuation of the one I was on. Everyone grabbed their stuff and left. Passengers and crew. When I realized that they weren't going to tell me anything, I grabbed my carry-on and got off, too. Not at the suggested of any FA, on my own. Seems that the continuation of the flight had left on time and UA didn't know I was on board. Neat! They put me there. So they put me on the next flight to SEA, which used the plane I had arrived on. So, I can see where the airline might have screwed up, but a lawsuit? YGTBSM!

The lawyer said they are looking for 25K to 75K in damages per the news last night.

Settle for 25K, the problem goes away and Mr Feiger can make his monthly payment on the Carribbean Condo.:D

OTOH, it comes on the heels of this story:

A man who boarded a Metro subway train in Montgomery County on Monday morning was found dead in the same train five hours later, the transit system said.

As recounted Tuesday by Metro, based on a preliminary investigation, the man apparently boarded the train at the Twinbrook Station about 10:15 a.m.

He remained onboard as the train headed south into the District and then on to Silver Spring. After the train turned around there, the man apparently was still onboard as it headed back into the District, and then on to the Red Line terminal at Shady Grove.

At Shady Grove, it was taken out of service about 11:55 a.m. and went into the rail yard there.

The body, which apparently had remained on the train, in the yard, for three hours, was found at 2:55 p.m. as the train was prepared for afternoon service.

Ah, back in the good old airline daze, I had to jump through a huge number of large hoops just to give school kids a tour of a DC-9 without any crew on board.

It helped that I, and one of my other folks, were both trained and current on evacuations. That kind of thing sometimes results from a Flight Attendant strike....

Nobody looks kindly upon passengers being left unattended on parked airliners.
