ELT Inop?

One of my partners in the plane recently sold his share. During the pre-buy for the new partner it was discovered that our ELT wasn't working correctly (very, very weak signal). As we had upgraded to an electronic version a few years ago it was still covered under warranty. The mechanic pulled the unit and sent it off for repair and placarded the ELT.

Question - is it legal to fly without an ELT? I won't debate the soundness of any decision, but is it legal?

It appears so.

91.207(f)(10) seems to cover it although 91.207(f)(3) could also apply.

OK, that explains why the placard states "Must be replaced within 90 days".
