DOJ using small aircraft to gather cell phone data

Some dumb pilots get a nice gov't wage and bennies to fly a C-182, yeah Murica!

I wonder why they can't just subpoena the info they need from the carriers though...?

Because no judge would let them go on a mass fishing expedition :dunno:

I think the Feds should add a new reg in,

unconstitutional use of an aircraft

Anyone who uses an aircraft to violate another persons constitutional rights, shall have any and all licenses and ratings revoked without possibility for reinstatement.

Thoughts?

Only problem is, where in the constitution do we have a right to privacy???

There are other threads here on POA about the use of these devices, although this is the first mention of using them from aircraft. Seems like unreasonable search and seizure to me.

Been there since 1791.

Amendment IV said:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

My thought is that they would just use non-certificated pilots in non-registered "public use" aircraft. It's perfectly legal for Big Brother government agencies to do that.

I think if you knew the feds were looking for you it would be pretty stupid to carry a gps tracking device in your pocket.
I'd strap my phone to the back of a stray cat.

Or toss it in the back seat of a cop car outside a donut shop.

That is interesting.
It is interesting....cept there's more to the story. It does require a warrant....and they've done this opperating out of my local airport. C-182 with a pod mounted on the wing. We gathered they were collecting data for the anthrax dude....it was about that time and near Ft. Detrick. Nothing came out of it....since the dude commited suicide.

Whatever you do....stay clear of these characters. If you get in their way.....They will do an unlawful search of your hangar and place tracking devices on your aircraft, unannounced I might add. They did so with a friend of mine.....located in the expensive hangars at the other end of the field. :yikes:

I guess this story doesn't shock me at all. I guess I have just assumed ever since I've had a cell phone that they have already been doing this. It is widely recognized that cellular communications are not secure and that the phone can be used to locate you. In addition, this story has as much hard evidence to prove it's existence as the UFO people and TIGHAR does.

Where are these planes, who are these people? What are the sources of this info? It seems like somebody over at ATC might notice a Cessna circling around and around in a busy urban area.

Well....that's how we discovered this activity in our area. Everyone looks out for each other and this strange plane was spotted orbiting our area....at certain times of the day for weeks on end.

According to The Ninth Amendment, rights don't have to be in The Constitution to exist.

Not according to many police departments. The PD in Tacoma, Washington, got one six years ago on the pretext that it was to help find IEDs:

http://www.thenewstribune.com/2014/08/26/3347665_documents-tacoma-police-using.html?rh=1

Formerly, they had to get a warrant to get the cell phone companies to hand over the data. Now they don't have to.

The question is, how well do police departments control their officers' use of the equipment? Can they only fire it up in approved cases, or can any cop check it out to track where his ex-wife is?

Tacoma PD has a *bad* history in the "Who watches the Watchers" department. Don't know why we'd want to trust them with this....

A BIG problem is that it's not unconstitutional for an individual to collect cell phone data. The Constitution applies to governments, not individuals.

It might be illegal, but there is no constitutional violation for an individual to break into your house and search everything you have.

If you're aiding a government in busting the constitution I say pull the license.

Ether way something needs to be done about this.

FISA courts have supposedly not turned down even 1 in 10 requests. So it's not the court thing. It's just faster and easier than bothering to go to them.

WTF is the big deal???.... Oh yeah...lets do something...give it a rest. They are looking for criminal activity.

If you are not A criminal who cares. They move on.

Infringing on my rights???... IDGAF....if they want to look at the selfies I gave to my wife that get her hot n excited before I hit the door....more power to em...Im gonna slice me off a piece when I get home.

No problem at all. Most Americans commit multiple crimes per day and the rule books just keep getting bigger. Makes it easier when you finally say something that bothers them or threatens their ill-gained power via unauthorized debt.

Huh???

If you think this will be used for petty stuff your dilusional.

Multiple crimes per day for most Americans....is laughable.

I've seen too many comments around the Internet just like this one.

It's moronic. Just because you have nothing to hide doesn't mean you should bend over to whoever wants to take a look. Congrats on being part of the problem.

Only if you **** off the wrong person. Not for everyone. The gathering of data if allowed to be used inappropriately is the issue at hand. See: IRS scandal. All you need is a database and a willingess to lie if caught. And some mystery hard disk failures in multiple locations at the same time.

The crime thing is well documented. Look it up. Lamented by those not particularly fond of an ever growing legal system with no automatic sunsets on bad law. You see, bad law pays lawyers better than good law.

Heck, it pays Federal judge appointees about $200K a year for the rest of their lives and they whine they're not making what a first year associate at a big firm makes. Or that's the story they repeat every year, anyway.

Haven't noticed yet that everyone in Federal positions says they need bigger loans against your paycheck to "serve" you every fiscal year?

So, we buy them some nice fake cell sites that run on 28VDC and send 'em up. Why not? More loans to gather info on whoever they feel like. Such a bargain. I certainly voted for it, didn't you? Gotta vote yes on creating more good gub'mint jobs doing stellar measurable work for the public.

Good luck with that FOIA request to find out what they're up to. Your loan money pays, but you're not good enough to know what it is spent on.

Sky is falling....oh noooooo!!!

Ever think this might be a reasonable solution to our silly open border policy?

Kinda protects you....but hey your worried about your silly texts being infringed upon...

Not part of the problem...your overreacting.

Flying cell sites around keeps illegal immigration from occurring? Who knew. Impressive.

I'm sure when the data is used inappropriately, and it will be, it'll be blamed on a couple of low level staffers from Cincinnati.

100% sure not used for illegal immigration.....so keep grasping.

Not sure if you know...but there is a possiblity of terrorists in the US.

Doom n gloom....is a good counter argument though.

You're the one who didn't define how you thought they'd be used. No grasping here, just following your dumb lead.

But hey sure. Let's drop all semblance of privacy and limited government because there might be a terrorist here. That is certainly worth it.

Let's not forget it was probably some more of that borrowed money that was used somewhere overseas to **** them off enough to want to travel the globe with a death wish and no fear of a life at Guantanamo Bay so bad they're willing to target civilians.

Must need to spend more money on government. They'll fix everything they ****ed up. They promise.

DHS is what? Only $20B a year. Cheap at twice the price, right?

Let's get rid of law enforcement too...save some more money....so your ideal of freedom can be justified some more.

You seem to misunderstand. I'm all for accountable law enforcement. But I'm sure we could cut LE budgets in half and really see no significant change in crime rates nor personal safety. Probably see a whole lot less time for minor traffic tickets though.

Crime in the U.S. has been on the decline since the 80's. Seems logical that LE budgets including DHS would have gone down in response, no?

Or if you want to argue that it's the additional expenditure on LE that's causing the decline, you may want to look up the definition of "diminishing returns". Paying 10 or 100 or 1000x the initial price for a service to gain single digit percentage changes per year in something is by definition a bad investment.

I'm pretty sure you're one of many still under the mistaken assumption that more money and bigger government means a better job done. You'll eventually get over it.

Or not. Depends on where your paycheck comes from. That always trumps reason.

Not everything government thinks up is actually worth doing. Most of it is ungodly expensive for very little measurable result and some of it pays no heed to the concept that government is here to serve us, not the other way around.

I have an excellent idea. Whoever ****ed off those terrorists? Take away funding for their security detail and send the terrorists their itinerary.

Should take care of it nicely. Lots cheaper too. It'll be really easy to find replacement egotists to replace all those who voted to send all the poorest of our country's kids to shoot at them.

Much much cheaper than all the domestic spy programs.

Maybe the next batch of politicians would think twice about voting to kill folk if we just couldn't find the pocket change to pay for their bodyguards for a couple of years.
