Was wondering if I need to see a HIMS AME if I complete drug court and my charges were dismissed or should I start the process now to save myself time
My story is I was caught up with 0.2 of black tar heroin about 4 months back and am on drug court now for another year and 4 months, after I complete drug court I will receive a dismissal of my charge, I was not driving when caught, I realize I’ve messed up and have been making major changes to my life since, I’ve accumulated about 4 months of clean time and have a record of my attendance to NA and AA but was wondering if I should wait till I complete the program and have my charges dismissed or should I just go ahead and start up with the HIMS AME and bite the bullet now?

I would post your inquiry to the Medical Topics subforum.

You will require, most likely, formal treatment at a facility, then a period of objectively documented abstinence (drug screens) and recovery meeting attendance. Most likely 24mos. If you are really serious and committed you will most likely get a medical issued (special issuance) contingent on long term documented sobriety. It will take a bit of time, various FAA recognized medical specialist visits, and a fair amount of money. It is very possible though but you are facing a battle.

You'll have to report your heroin use the next time you fill out Medxpress, along with the arrest. It would be a good idea to have a CONSULT with a good HIMS AME to chart a path forward BEFORE you send anything to the FAA. The sooner you have that consult, the sooner you can start the long process to get a medical. If you're eligible, you might consider Basic Med or Sport Pilot for a while.

From what I saw in three decades of law enforcement, get back to us when you have five years of no substance use of any type other than what is legally and properly (complies with medical standards) prescribed. I really hope you are successful, but real talk, maybe one out of a hundred going through drug court stay clean. At least 80% are using again within a six months max.

Drug court is typically reserved for drug addicts; which is why drug court programs are 12-18 months in most places. Possession of the .02 grams is not why you are in drug court, your constant use is. First time offenders get diversion, the others get probation/incarceration. Think about why you are in the drug court, work the program, and learn from it. Once you get to the 1 year stage, you can start looking at other things as you should be a different person by then.

The only people I've seen succeed through drug court are those who were honest with themselves, had a true desire to change, and put in the effort.

Go get a consult from a knowledgeable AMI ,that way you can institute a plan of action that will be acceptable to the FAA
