I would have argued an APA violation. The regulations are not "clear" on the matter. The phrase "holding out" does not actually appear in Part 61.113 anywhere. The phrase appears only in "interpretations" of the regulation. If the FAA wants to prohibit holding-out in 61.113, they should...
