CPL stuff: Private, Non-common, common carriage ... oof

You are correct. One of the collateral consequences of the FAA's current enforcement focus on illegal charter is looking at the pilot in those types of situations and requiring the pilot to understand that, for example, a dry lease in name is really wet. In those cases, the pilot's certificate...

    It's official... BasicMed expanded

The number of people who seem to overestimate the impact of overturning Chevron by thinking an agency's interpretation will be disregarded is amazing. Determining whether an agency's actions are consistent with a statute is a very different that not caring what the agency says. It's getting...

    Lien Issue

One question I would definitely ask the lawyer is their opinion of the likelihood the lien is invalid. You may decide the risk is low enough to buy the airplane and pursue the quiet title action after the purchase. That solves the timing problem. Title insurance buys you two things. 1...

CPL stuff: Private, Non-common, common carriage ... oof

No. The photography exception in 119.1 is sort of like the air tour one. Takeoff and landing at the same airport with no landings at another. That’s aside from the FAA saying your claim it was just a photo flight is a sham. On flying the co-owner, probably ok since the co-owner has operational...

Why is BasicMd listed as a medical "waiver"? I’m still waiting to hear of a commercial applicant quizzed on the flight department company rules :D

    Lien Issue

Gotcha! But I wouldn't rely on "oh, it's OK" if the lien is still on record without a release. Heck, I can probably look at the record and say, "no problem for you while you own it" but unless it's off record, the issue is going to repeat itself with every future sale. The "weird" one I...

New owner - question regarding annual timeout

Well, playing language police (one of those days), it doesn't "imply" it. It "says" it, using the same standard "calendar month" language that's used another 75 times in the FAR.

    Lien Issue

If Aerospace cleared it, it would not show up today as a problem. Yes, the lien would be on the record, but so would the release.

I have no children but I used to get those from people in jail.

    Lien Issue

An airplane is not "real property." And while I don't know California law, having worked for a company which wrote banking software, I don't know of any state which gives security interests unlimited life (assuming this particular lien is a security interest to a bank and not for some other...

Gear up landing, when does the FAA get involved?

Your two stories are not at all unusual. And with a little thought, they both make sense.

CPL stuff: Private, Non-common, common carriage ... oof

Sorry, I haven't got past the first right-hand bubble where you are requiring a third class medical for activities which may be done with BasicMed. I have a bias against trying to use a flowchart for things which are more complex. They are kind of like mnemonics - a way to avoid learning...

What is too windy for training in a 172?

I taught at KAPA in Colorado where the wind direction typically moved clockwise. Main runways N-S. Winds light from the SE in the morning, increasing in intensity to a strong direct westerly crosswind in mid afternoon, and diminishing in the evening. We’d schedule lessons accordingly based on...

    Lien Issue

It might help a bit to get one who understands the FAA , but any commercial/banking lawyer will understand the lien and how to get rid of one, especially one that’s probably no longer valid. They will also know how to trace the bank ownership, and may be able to handle this without a lawsuit...

Gear up landing, when does the FAA get involved?

Of course they wanted to know how it happened. Especially if it wasn’t pilot error. Exactly for the reason you say.

Gear up landing, when does the FAA get involved?

Funny, I get the impression from the question that our guest thinks there is some vast conspiracy at work, when all it is in terms of the FAA, local LEO, ambulances, fire trucks, the newspapers and TV stations, etc etc, is that someone called.

Gear up landing, when does the FAA get involved?

    Maybe it’s a conspiracy!

Gear up landing, when does the FAA get involved?

If someone calls them. The typical gear up landing is not a reportable event from an NTSB standpoint, but someone often calls in the FAA or NTSB. Obvious is when an airport or runway needs to be NOTAM’d closed while the airplane is removed, but I’ve even seen ramp retractions/collapses called...

GFC-500 is a GPS only Autopilot

I guess the manual requires us to understand what an autopilot “mode” is and that, for example, NAV mode is NAV mode regardless of the source of the NAV information. A different lateral mode than NAV is HDG or ROL.
